Hysteria makes all Sex unsafe
The following text is an excerpt from an article on the Classically Liberal blog. We all worry about teens and the risks associated with sex. No one wants young girls to get pregnant or for teens to spread venereal diseases. Like it or not, to the extent that so-called sexting replaces actual sex as an expression of erotic needs, it replaces higher-risk sexual activities with lower-risk activities. But state laws make all teenage sex dangerous. It isn’t dangerous because there are consequences to actions that nature imposes. In nature there is always a cost to something. Governments, however, like to screw around with that premises.
So they minimize the risks of some bad things by subsidizing them. For instance, government will subsidize tobacco growing, help subsidize people who get cancer from smoking, provide “insurance” to people who build in flood planes, etc. All of these are cases where government lowers the cost of risky behavior thus encouraging more of it. At the same time Nanny increases the risks artificially in other areas. Two teens exchanging dirty photos are clearly less at risk than if they were bonking behind the swingset unless the state gets involved. At that point it becomes very dangerous indeed. The fact is, that even the safest sex, for young people, is highly dangerous when politicians take note. This was what two randy students in Valparaiso found out recently. The middle school students had used their cell phones to exchange nude photos. Now these two kids are charged with being child pornographers.
The girl involved apparently forgot to turn off her cell phone in school. The phone rang and the teacher confiscated it. Local papers report: “The teacher told police the girl asked to delete something from the phone before it was turned over to the administration, but that request was denied.” Now this immediately raises some questions. While I can see the school requiring students to turn off cell phones, and I can even fathom why they might have the right to confiscate a ringing cell phone from a student, what I don’t see is how they had any right to search the contents. Merely asking to delete something from the phone is not a justification for a warrantless search.
Of course, the busybody schoolteacher, and remember in government systems teachers are part of the State, apparently told the police. And somebody, and I would bet without a court order, went through the phone. That was when they discovered that a few days ago the girl, and a boy from the school, had exchanged racy photos. Now, if you want the pure hypocrisy of the State on this matter consider the justification used by Deputy Prosecutor Cheryl Polarek. The local paper says she “said young people don’t understand the ramifications of texting nude photos… She said a nude picture could end up being shared with half the school and could get in the hands of people who seek out child pornography.”
Think about this. If a kid takes an erotic photo of him/herself the whole school could find out. But to protect kids from having that happen the State, in this case Cheryl acting as the State, makes sure the entire school finds out. And, to top it off, she prosecutes the kids, they can face jail time, and they can be forced to register as sex offenders depending on the whims of the prosecutors or the law. So, to protect a couple of “stupid kids” from some bad consequences we will subject them to even worse consequences, some of which can plague them till the day they die. And need I point out that the actual consequences for the kid are worse when the photos end up, not in the hands of someone who seeks out such things, but in the hands of teachers, school officials, police officers and prosecutors. We all know the reality of schools. Once the police got involved, and the boy and girl in question were arrested, it was only minutes before every single student knew who was arrested and why. The police may not release the names because they are minors but there is no privacy. And when all the kids knew, it was only a few hours before all the mothers knew, and when all the mothers knew, you can bet most the town found out shortly afterwards. Now, without condoning what these kids did, can anyone tell me how the situation could have been worse for the couple, if they weren’t being “protected” so much by the police and school officials? When will people figure out that most legitimate problems are merely made worse by state intervention? If the goal is to minimize harm to kids, shouldn’t we keep them out of the clutches of the police and, dare I say it, the teachers. Read on…

At least these folks kept it in the juvenile court system. I’ve seen instances where they saddled a child with adult charges, and required sex offender registration for life. Of course this precludes any job short of manure spreader, since they ecen do background checks for a job at McDonalds’s. . So his/her future is destroyed.

Once again, Sex is what is being made illegal and unacceptable. When the government can legitimately reign in Sex as it can with Sex Crimes, it is only a another step to start limiting so called ‘deviant’ forms under the guise of protecting children (the term children used for males and females 18 years old… the supposed age of consent and adulthood).
It sounds extreme and it certainly exceeds logic and reason. But my feeling is that logic, reason and rationality have little to do with the rash of laws being written since 1990. Laws to protect children from abuse has snowballed into truly Machiavellian heights. It may not be the laws that are at fault, but the prosecutors and elected officials who see using them to garner the religious, or the middle class family adult by promising to use the laws to their best effect. Working on fear, religious bias and total misconceptions, legislators are quite willing to pass laws to effectively attack the sub-cultures that do not fit into the ‘norm’ generally seen as acceptable by the majority of voters. Fortunately we have groups like the ACLU, GLBT and others that raise the alarm or fight when these get out of hand.
Im afraid that given our current culture, the appreciation and love of boys (ephebephile) is going to be driven underground and lumped in with Pederasty and Sex Predators. This includes the outlawing of any pictures of any type (as yet not true in the US) and stiff sentences for offenders including Megan’s Law, the forced participation in the sex offenders database for the rest of a person’s natural life. And as you can see, it can easily spill over into the very group that the laws were meant to protect. This is the slippery slope and we are on it heading south. While these laws were made with every good intention to protect the helpless, it is best to remember that ‘ the road to Hell is paved with good intentions.’ (not coined by Samuel Johnson but probably influenced by ‘Hell is paved by good intentions or desires’)

Lawyers for the girl may be able to suppress the evidence at trial if the discovery was made by the police as opposed to school authorities. I really think the problem here is with the prosecution. This is the sort of case in which the girl and her telephone should have been turned over to her parents, and the parents of the boy informed.

I think this is really sad, two people the same age who like each other sending harmless photos. Firstly it makes no sense to prosecute children as adults and call them child pornographers when they are children themselves. At my local school a few years ago, a boy made a gun threat that shut the school down for the day as they searched for the gun. They found his list of names with the kids he wanted to shoot. In the USA you can be prosecuted for attempted murder, and particularly if it was planned. They did not find the weapon, the kid got off with a slap on the wrist. This boy was the kind of kid that was always in trouble, and would probably have a gun. Ironically he is in prison now for a different crime. But my point is these harmless photos were really not hurting anyone, and these kids get prosecuted to the max, and you have a kid who had intended to kill, walks away like nothing happened. There is really something wrong with the message the government is giving to us. Some of those creeps probably keep the photos for themselves anyway.

The only thing I don’t like about this article is that taking and sending nude photographies of one’s own body is still considered something evil. It might sound very naive, but yes, I have indeed sent photos to other people, and no, I don’t regret it – why should I? I’ve had fun sending those photos (both to people close to me and to people I didn’t know very well), the person I sent them had fun looking at these pictures, and nobody was harmed – so what’s the bad thing about it?
In Germany, we say “Where there is no plaintiff, there’s no need for a judge.” – and that’s exactly how I feel about the situation in this article.

Here in Texas where I live on the Mexican border its okay for a Latino cop of 34 yrs of age to knock up a 15yo white girl and marry her at 16, but wrong for a 49yo white guy (me) to have a 17yo white bf. Both the girl and my bf had/have consented. The two opposing differences are straight to gay and yet the age of consent in Texas is 17 not 15. So the straight arraingment isnt frowned upon as much as the gay one despite the supposed legal ramifications.
